Terms of Service for Bonvivant
Welcome to Bonvivant, operated by Bonvivant Safety Eyewear Company, Inc. (“Bonvivant”), available online at our website (e.g., www.Bonvivant-safety.store, referred to as the “Site”), on our social media platforms, and offline through customer support, retail locations, and in-person promotional events (collectively, the “Platform”). These terms and conditions (the “Terms”) govern your use of our Platform. By accessing, viewing, purchasing, or using the content, materials, products, or services available through the Platform, you acknowledge that you have read, understand, and agree to be bound by these Terms and our Privacy Policy, incorporated here by reference.
Arbitration Agreement: Section 11 of these Terms outlines the dispute resolution process, including binding arbitration for most claims. Unless you opt out, disputes must be resolved individually in arbitration, waiving your right to a jury trial and participation in class or representative actions.
By using the Platform or any services provided through it (collectively, the “Services”), you certify that you are at least 13 years old and have the authority to agree to these Terms and fulfill the obligations herein. Please review these Terms and our Privacy Policy carefully, as using the Platform signifies your full acceptance.
1. Registration
To access certain Services, you may need to create an account. Registration may require you to agree to these Terms and provide information such as a user name, password, and personal details (e.g., legal name, phone number, address, email). Your information must be accurate, complete, and kept up-to-date. Failure to do so may lead to account suspension or termination.
Orders placed through the Platform require additional personal information (e.g., shipping and billing addresses, payment details). Bonvivant or its third-party providers may collect further information for security purposes. You confirm that all personal information provided is true, complete, and up-to-date, and that you are the individual referred to in the shipping and billing details. For changes to your account information, please update directly on the Platform.
Personal information will be managed in accordance with our Privacy Policy.
2. Purchases
The Platform allows you to browse and purchase products and services. By purchasing, you represent that you are of the legal age of majority (usually 18 years old in most U.S. states) and capable of entering a contract. If under the age of majority, a parent or guardian must review these Terms and make purchases on your behalf. Purchases should be for personal or household use only and not for resale or export. Purchases must be intended for delivery within the U.S.
Purchases of commercial quantities require prior written consent, and we reserve the right to limit or cancel orders that suggest intent to resell or distribute. Orders may be restricted or refused at our discretion, particularly if related to policy violations. Unauthorized use of Bonvivant products or gift cards for promotional purposes (e.g., prizes, contests) is prohibited unless expressly approved by us. We may refuse services, cancel orders, or suspend accounts of users violating these Terms.
Availability of products on the Platform is not guaranteed. For special order inquiries, contact service@Bonvivant-safety.store.
Prices and availability are intended to be accurate but may occasionally contain errors or omissions. We reserve the right to correct such errors and cancel any resulting orders. Promotional codes, when available, must be entered at checkout and cannot be combined with other offers.
Bonvivant may use third-party payment processors for transactions. You are responsible for applicable taxes on purchases (excluding taxes on Bonvivant’s income), which will be added to your bill if required. Title and risk of loss transfer to you upon delivery to the carrier. Sales are subject to our shipping and return policies provided on the Platform or with your order. Return abuse may result in return limitations or account restrictions. Refunds are at Bonvivant's discretion.

3. General Restrictions on Use
You agree to utilize the Platform and Services solely for purposes allowed by these Terms and in accordance with all applicable laws, regulations, and generally accepted practices within relevant jurisdictions. Your use of the Platform, products, and Services is limited to personal, non-commercial, non-exclusive, non-transferable, and non-assignable purposes only.
You agree not to (and will not attempt to):
Access the Services by any method other than the interface provided by Bonvivant, including: (i) accessing, tampering with, or using non-public areas of the Services, Bonvivant's computer systems, or technical delivery systems of its providers; (ii) attempting to probe, scan, or test the vulnerability of any Bonvivant system or network or breach any security or authentication measures; or (iii) bypassing, disabling, deactivating, impairing, or otherwise circumventing any technological safeguards put in place by Bonvivant or any third party (including other users) to protect the Services or Platform.
Gain unauthorized access to Bonvivant's computer systems or engage in any activity that disrupts or compromises the functionality, performance, or security of the Platform, Services, or Bonvivant’s networks and computer systems.
Access the Platform or Services using automated means or automated features, such as scripts or web crawlers.
Access or gather any personally identifiable information (e.g., names, email addresses) for any purpose, including but not limited to commercial purposes.

4. Content Ownership and Use
Bonvivant owns or licenses all information and materials, including logos, designs, titles, product names, images, illustrations, icons, photographs, and the related copyrights, trademarks, service marks, trade dress, and other intellectual property rights associated with the Platform (“Platform Content”). This includes the selection, coordination, arrangement, and enhancement of Platform Content. All Platform Content is protected under applicable copyright, trademark, patent, and other laws. You agree not to remove or modify any copyright or proprietary notice on any Platform Content. All names, trademarks, symbols, slogans, or logos on the Platform, products, or site are proprietary to Bonvivant or its affiliates, licensors, or suppliers. Any unauthorized use or misuse of these trademarks is strictly prohibited and may violate trademark law. You will not have any rights to Platform Content beyond the right to use it in compliance with these Terms.
Certain features of the Platform may allow you to post feedback or information that can be accessed by other users (“Comments”). By posting Comments, you represent that you have the right to provide them and that their use by Bonvivant, the Platform, and others will not: (a) infringe any intellectual property or privacy rights of any person; (b) violate any laws or agreements; (c) disclose confidential information owned by third parties; or (d) contain harmful, illegal, or inappropriate content. By submitting Comments, you grant Bonvivant an irrevocable, perpetual, transferable, and royalty-free license to use, publish, display, modify, and sublicense them without compensation. You agree to indemnify Bonvivant for any claims resulting from your Comments. Bonvivant reserves the right, but not the obligation, to monitor and remove any content or activity. Bonvivant assumes no liability for content shared by you or third parties on the Platform.
5. Errors, Inaccuracies, and Omissions
Occasionally, there may be errors or omissions in the information presented on the Platform related to product descriptions, pricing, promotions, offers, and availability. We reserve the right to correct these errors and to update or change information or cancel orders if any inaccuracies are found, including after an order has been submitted. While we strive for accuracy, we are not obligated to review all communications, products, or services on the Platform. Bonvivant may review, edit, or remove any content or features at any time without prior notice.
6. Disclaimers and Warranties
Bonvivant reserves the right to change product offerings and limit quantities available at any time without prior notice. We also reserve the right to adjust terms or durations of special offers. Bonvivant is not responsible for stock outages or unavailability of products. We make reasonable efforts to display product colors accurately, but we cannot guarantee your device’s display will reflect actual colors.
To the fullest extent permitted by law, Bonvivant disclaims any implied or express warranties that the Platform, products, or services will meet your expectations; be uninterrupted, secure, or error-free; or that any software issues will be corrected. Information provided by the Platform or third parties should not be considered an endorsement. Technical processing and transmission of Platform Content may involve unencrypted transfers and adaptions to connect to various networks.
Bonvivant assumes no liability for errors, delays, unauthorized access, or issues with communication lines, computer systems, or network interruptions related to Platform use. Bonvivant is not liable for damages caused by external factors, such as natural disasters, changes in law, or other uncontrollable events.
7. Limitation of Liability
Bonvivant’s liability is limited to actual and direct damages proven in court, and shall not exceed the amount you paid for the product or service in question. If any portion of this limitation is deemed unenforceable, the maximum liability will not exceed ten dollars ($10).
Bonvivant will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including loss of profits, business reputation, data, or other intangible losses. This includes any reliance on advertisements, Platform changes, or issues with data deletion or unauthorized access.
If you are dissatisfied with the Platform or these Terms, your sole remedy is to discontinue use.

8. Indemnity You agree to defend, indemnify, and hold harmless Bonvivant, its officers, directors, members, employees, agents, affiliates, licensors, and suppliers, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including legal fees) arising from: (i) your use of and access to the Platform and Services; (ii) your violation of any of these Terms, including the Privacy Policy; (iii) your violation of any third-party rights, including but not limited to copyright, intellectual property, or privacy rights; or (iv) use by any other person accessing the Platform using your account or login. This indemnity obligation will survive the termination of these Terms and your use of the Platform and Services. Bonvivant reserves the right, at its own expense, to assume exclusive defense and control of any matter otherwise subject to indemnification by you, and you agree to cooperate reasonably in such defense. You may not settle any claim without prior written consent from Bonvivant.
9. Links to Other Sites The Platform may contain links to or references for other websites outside of Bonvivant's control. These external sites may use the Bonvivant logo or branding under a co-branding agreement. Please be aware that these sites may use cookies, collect personal information, and apply practices that differ from those of Bonvivant. Bonvivant has no control over these sites, and these Terms do not cover their use. Bonvivant is not responsible for the content, services, or damages that may arise from interactions with third-party sites. It is encouraged that you review the privacy policies and terms of any external websites you visit.
10. Complaint Procedures If you believe any content or postings on the Platform infringe your intellectual property or other rights, you may notify Bonvivant by email at support@Bonvivant.com with a detailed message including: (a) your name and company (if applicable); (b) your contact details; (c) the nature of your complaint, the specific rights at issue, and your justification for the complaint; and (d) the statement: “The statements, representations, and assertions made in this message are true, complete, and accurate, and I have the full legal authority to make each statement and demand in this message.”
11. Dispute Resolution You and Bonvivant agree to waive any right to litigate claims in court or before a jury or to participate in class actions. Disputes will be resolved exclusively through binding arbitration by the American Arbitration Association (AAA). Arbitration will occur in [designated city/state], unless Bonvivant elects otherwise. An arbitrator may award the same damages and relief as a court, and all proceedings must be on an individual basis. You agree that neither you nor Bonvivant will bring or join any class action. If a court finds any part of this agreement unenforceable, it will sever that part, and the rest will remain in effect.
12. Miscellaneous These Terms, including the Privacy Policy, represent the full agreement between you and Bonvivant, governing your use of the Platform, products, and services, and supersede prior agreements. Conflicts between any posted rules and these Terms will defer to these Terms. Bonvivant may revise these Terms, and continued use of the Platform indicates acceptance of such changes. It is your responsibility to check for updates. The Terms are governed by the laws of [relevant state] without regard to conflict-of-law principles. The Platform is operated from the U.S., and access from locations where content or services are unlawful is prohibited.
